These Terms of Service ("Terms") are a legally binding agreement between you and Buywander ("Buywander," "we," "us," or "our") governing your access to and use of Buywander's websites, mobile experiences, applications, auction services, pickup services, account features, communications, and related products and services (collectively, the "Buywander Platform").

Please read these Terms carefully. By creating an account, accessing or using the Buywander Platform, placing a bid, winning an auction, using any platform feature to remove a won item from your cart, purchasing an item, scheduling a pickup appointment, picking up an item, returning an item, or otherwise using any Buywander service, you agree to be bound by these Terms and any policies incorporated by reference.

If you do not agree to these Terms, do not use the Buywander Platform.

These Terms include important provisions about binding bids, payment obligations, checkout deadlines, removal from cart, pickup deadlines, return deadlines, appointment rules, refund deductions, account fee balances, restrictions on bidding and platform use, disclaimers of warranties, limits on liability, and dispute resolution.

Policies Incorporated By Reference And Order Of Control

Additional Buywander policies may apply to your use of the Buywander Platform and are incorporated into these Terms by reference, including:

1. Returns, Refunds & Fees Policy: explains return eligibility, refund methods, pickup deadlines, return deadlines, appointment rules, cart removals, fee balances, and restocking fees.
2. Privacy Policy: explains how Buywander collects, uses, stores, and shares personal information.
3. Any item-specific terms, auction-specific terms, location-specific rules, fee schedules, support-approved exceptions, checkout disclosures, bid confirmations, cart notices, appointment confirmations, fee confirmations, refund receipts, and other rules or notices posted or presented by Buywander.

If there is a conflict among these Terms, an incorporated policy, an Item-specific disclosure, an auction-specific disclosure, a checkout or appointment disclosure, a fee disclosure, or a written support-approved exception, the more specific disclosure controls for the affected Item, transaction, appointment, fee, or service. For example, an Item page, checkout notice, appointment flow, refund receipt, fee notice, or written support-approved exception may control over the general language in these Terms for that specific Item, fee, appointment, return, refund, or transaction.

General customer support conversations, informal statements, marketing materials, or operational accommodations do not change these Terms unless Buywander confirms the change or exception in writing through an authorized support-approved exception or another written notice from Buywander.

1. Eligibility And Account Registration

You must be at least 18 years old and legally able to enter into a binding contract to use the Buywander Platform.

To place bids, purchase items, schedule pickups, remove won items from your cart, return items, or use certain features, you must create a Buywander account. You agree to provide accurate, current, and complete account information, including your name, email address, phone number, billing information, payment information, and any other information requested by Buywander.

You are responsible for maintaining the confidentiality and security of your account credentials. You are responsible for all activity that occurs under your account, whether or not you authorized it, unless applicable law provides otherwise. You must notify Buywander immediately if you believe your account has been accessed without authorization.

Buywander may approve, deny, suspend, restrict, or terminate any account at any time if Buywander believes the account information is inaccurate, incomplete, unverifiable, fraudulent, duplicative, abusive, or otherwise inconsistent with these Terms or Buywander's policies.

You may not create or use multiple accounts to evade account restrictions, bidding limits, free removal limits, unpaid fee balances, suspensions, or other Buywander rules.

2. The Buywander Platform And Auction Items

The Buywander Platform allows users to browse, bid on, win, pay for, pick up, and return eligible auction items and other goods (collectively, "Items").

Items listed on the Buywander Platform may include returned merchandise, overstock goods, open-box goods, used goods, damaged goods, incomplete goods, customer returns, shelf pulls, liquidation inventory, and other product categories. Item condition, packaging, completeness, accessories, functionality, labels, retail packaging, model information, and appearance may vary.

Unless Buywander expressly states otherwise, Items are sold "as is," "where is," "with all faults," and subject only to Buywander's posted return policy and any Item-specific terms. You understand that Buywander's inventory model involves variable-condition goods and that Item photos, titles, descriptions, estimated retail values, condition notes, and other listing information may be imperfect, incomplete, or based on information available to Buywander at the time of listing.

Buywander may act in different capacities depending on the Item, listing, seller relationship, inventory source, or transaction structure. Buywander may own, possess, store, inspect, list, facilitate, sell, or fulfill Items, or may provide a platform or services for third-party sellers or suppliers. Nothing in these Terms limits any rights you may have under applicable law that cannot legally be waived.

Buywander does not guarantee that Item listings, photos, titles, descriptions, condition notes, categories, dimensions, model numbers, retail values, quality ratings, or other listing information are complete, accurate, current, or error-free. You are responsible for reviewing all available listing information before bidding.

Buywander may correct, update, withdraw, cancel, relist, extend, or modify listings, auctions, bids, sales, appointments, or transactions at any time in its discretion, including where Buywander identifies a listing error, inventory issue, suspected fraud, system issue, pricing issue, policy violation, or operational constraint.

3. Bidding

By placing a bid, you are making a binding offer to purchase the Item if you are the winning bidder. Bids are final and may not be canceled or retracted unless Buywander agrees in writing, Buywander confirms removal of the won Item from your cart under Section 6, or applicable law requires otherwise.

If you are the highest bidder when an auction ends and the auction requirements are satisfied, you are the winning bidder and are obligated to complete the purchase, pay all amounts due, and comply with all cart, payment, pickup, return, fee, and account rules.

Buywander's system records are the final record of auction timing, bid timing, bid amounts, winning bids, auction extensions, and auction results.

Buywander may reject, cancel, or void any bid or transaction that Buywander believes, in its discretion, was made in error, made without intent to pay, made using automated tools, made to manipulate the auction process, made in violation of these Terms, or otherwise harmful to Buywander, sellers, buyers, or the integrity of the Buywander Platform.

You may not engage in shill bidding, coordinated bidding, bid manipulation, use of bots or automated bidding tools not authorized by Buywander, interference with other bidders, account sharing to evade restrictions, or any conduct intended to undermine the fairness or integrity of an auction.

4. Checkout, Payment, And Taxes

You agree to pay all amounts owed for Items you win or purchase, including the final bid price, Buyer's Premium, taxes, removal from cart fees, restocking fees, unpaid fee balances, and any other disclosed fees or charges (collectively, “Charges”).

Buywander may require payment before pickup, at checkout, when scheduling pickup, after auction close, before a checkout deadline, or at another time disclosed by Buywander.

Buywander may accept or reject payment methods in its discretion. Payment processing may be handled by third-party payment processors. Buywander is not responsible for delays, denials, processing errors, card network decisions, bank decisions, or other issues caused by third-party payment processors or financial institutions.

You are responsible for maintaining a valid payment method where required. If you are the winning bidder or otherwise incur financial obligations under these Terms, you authorize Buywander and its payment processors to charge your selected payment method for all Charges then due, subject to applicable law. If a payment fails, is declined, is reversed, is disputed, or otherwise cannot be completed, Buywander may cancel the transaction, remove the Item from your cart or account, restrict your account, require another payment method, add unpaid amounts to your account fee balance, or take other action permitted by these Terms.

You are responsible for all applicable taxes unless you provide a valid exemption certificate accepted by Buywander before the transaction. Buywander may collect and remit sales tax or other taxes as required by law. Errors in tax calculation or collection do not relieve you of any tax obligations.

5. Buyer's Premium And Operational Fees

Buywander may charge a Buyer's Premium on Items sold through the Buywander Platform. The Buyer's Premium is Buywander's service charge and is added to the final selling price of an Item. Any applicable Buyer's Premium will be disclosed in the listing, auction terms, checkout flow, or other transaction-specific notice.

Buywander may also assess operational fees described in these Terms or otherwise disclosed to you ("Operational Fees"). Operational Fees may include removal from cart fees, fees for automatic cart removals after a checkout deadline, restocking fees, same-day appointment change fees, no-show fees, unpaid fee balances, chargeback-related amounts, collection-related amounts, and other fees tied to your account activity, orders, appointments, pickups, returns, payments, disputes, or platform use.

Operational Fees may be handled in different ways depending on the fee type and the transaction. For example, a restocking fee for an Item that is not picked up by its pickup deadline may be deducted from the refund for that Item. Other Operational Fees, including removal from cart fees, automatic cart removal fees after a checkout deadline, same-day appointment change fees, and no-show fees, may be added to your account fee balance and shown on your account's fees page or another account notice.

Buywander will disclose material Operational Fee triggers and amounts through these Terms, an incorporated policy, the Buywander Platform, a checkout flow, an appointment flow, an account notice, an Item-specific notice, or another reasonable transaction-specific notice before the fee is incurred, except where a fee results from payment failure, chargeback activity, fraud, abuse, legal process, or other circumstances where advance disclosure is not practicable or not required by applicable law.

All amounts owed must be paid before Buywander is required to release any Item, allow additional bidding, allow new transaction activity, or provide additional services, unless Buywander states otherwise in writing or applicable law requires otherwise.

Operational Fees are intended to compensate Buywander for labor, storage, handling, racking, re-picking, restocking, relisting, lost appointment capacity, administrative work, payment processing, fulfillment, dispute handling, and related costs. The parties agree that these fees are a reasonable estimate of Buywander's costs and are not intended as penalties. Unless Buywander states otherwise in writing or applicable law requires otherwise, fees are non-refundable.

6. Removing Won Items From Your Cart And Automatic Cart Removals

After you win an auction, the won Item may be added to your cart or account for checkout and pickup. Where the feature is available, Buywander may allow you to remove certain won Items from your cart before payment or pickup.

Each calendar month, Buywander allows you to remove up to ten (10) won Items from your cart without a removal from cart fee. After you have used your monthly free removal allowance, each additional won Item you remove from your cart during that calendar month is subject to a $2.00 per-Item removal from cart fee.

If you do not complete checkout or payment for a won Item by the applicable checkout deadline, Buywander may automatically remove that unpaid won Item from your cart or account. An unpaid won Item that is automatically removed after the checkout deadline counts as a cart removal for purposes of your monthly free removal allowance and any removal from cart fee after that allowance is used.

Removing a won Item from your cart is effective only when Buywander's system or support team confirms the removal. Removing a won Item from your cart cancels your ability to purchase or claim that Item. Once removed, the Item may be returned to inventory, relisted, resold, donated, recycled, disposed of, or otherwise handled by Buywander in its discretion.

Free monthly removals are account-level allowances. They do not create a cash credit, refund right, or transferable benefit. Unused free removals do not roll over to later months unless Buywander states otherwise in writing.

Buywander may restrict, deny, revoke, or modify the ability to remove won Items from your cart for certain Items, accounts, auctions, locations, or circumstances, including where Buywander suspects abuse, duplicate accounts, excessive removals, bidding without intent to pay, fraud, or other conduct inconsistent with these Terms. Free removals are intended as a limited customer convenience, not a right to bid without intent to purchase.

Removal from cart fees, including fees for applicable automatic cart removals after a checkout deadline, are generally added to your account fee balance rather than deducted from an Item refund. Unpaid removal from cart fees may restrict your ability to bid or use transaction features of the Buywander Platform as described in Section 9.

7. Pickup And Return Deadlines

Unless Buywander states a different deadline in writing, in an Item listing, in your account, or in a location-specific rule, each Item must be picked up or returned within seven (7) business days after the auction for that Item ends.

For purposes of these Terms, a "business day" means a day when the applicable local Buywander warehouse is open for customer pickup and returns for the Item at issue, excluding federal holidays and any other day the applicable pickup location is closed to customers. Deadlines are based on the local time of the applicable warehouse.

The pickup deadline and return deadline for each Item are calculated using business days for the applicable local warehouse. These deadlines may be shown in your account, Orders page, appointment flow, email, text message, Item listing, checkout flow, or other Buywander communication. If a specific deadline shown in your account or Orders page differs from the general rule in these Terms, the specific deadline shown for that Item controls unless Buywander confirms otherwise in writing. You are responsible for checking and complying with these deadlines.

Your pickup deadline and return deadline are currently the same date: seven (7) business days after the auction for that Item ends, unless Buywander states a different deadline for that Item.

Because the pickup deadline and return deadline are currently the same date, picking up an Item near the end of the deadline may leave little or no remaining time to return that Item. You are responsible for reviewing the pickup deadline and return deadline before bidding and before scheduling pickup.

If you do not pick up an Item by its pickup deadline, Buywander may cancel the pickup or transaction for that Item, return the Item to inventory, make the Item unavailable for pickup, and, subject to applicable law, relist, resell, donate, recycle, dispose of, or otherwise handle the Item in Buywander's discretion.

If an Item is not picked up by its pickup deadline, Buywander will generally automatically refund the amount paid for that Item, less any applicable $2.00 per-Item restocking fee and any other refund deductions permitted by these Terms and applicable law.

The $2.00 per-Item restocking fee for not picking up an Item by its pickup deadline is generally deducted directly from the refund for that Item. If the refund amount is less than the applicable restocking fee, Buywander may cap the deduction at the refundable amount unless Buywander discloses a different treatment and applicable law permits it.

Buywander may send one or more pickup deadline, overdue pickup, cancellation, refund, fee, or abandoned Item notices by email, text message, account notice, Orders page notice, appointment notice, or another reasonable method. Unless applicable law requires a different notice or waiting period, notice may be provided before or after the pickup deadline.

If an Item remains unclaimed after the pickup deadline and any notice or waiting period required by applicable law, Buywander may treat the Item as abandoned or forfeited to the extent permitted by applicable law. Once Buywander cancels pickup, refunds an Item, returns an Item to inventory, or otherwise treats an Item as abandoned or forfeited because it was not picked up by the pickup deadline, you waive all rights to title, claims, and interest in such Item and no longer have any right to pick up, receive, inspect, return, or claim that Item unless Buywander separately agrees in writing or applicable law requires otherwise.

Buywander's continued possession of an Item after the pickup deadline is an operational accommodation only. It does not extend your pickup deadline, return deadline, appointment deadline, refund rights, or other obligations unless Buywander confirms an extension in writing.

8. Pickup Appointments, Same-Day Changes, And No-Shows

Buywander may require or allow you to schedule pickup appointments for won Items. You are responsible for selecting an appointment time you can attend and for confirming which Items are included in each appointment.

If Buywander has enabled and disclosed late appointment change fees, you may be charged a $2.00 per-Item restocking fee if you change, reschedule, or cancel a pickup appointment less than four (4) hours before the scheduled appointment time, based on the local time of the applicable pickup location.

For example, if your appointment is scheduled for 3:00 p.m. and you change, reschedule, or cancel it after 11:00 a.m. that same day, Buywander may assess a $2.00 per-Item restocking fee for the Items included in that appointment.

If Buywander has enabled and disclosed no-show fees, you may be charged a $2.00 per-Item restocking fee if you do not check in for your scheduled pickup appointment within one (1) hour after the scheduled appointment time, or by another time disclosed to you by Buywander, and you have not completed pickup, canceled, or rescheduled through a Buywander-approved scheduling flow or written support confirmation.

No-shows are determined based on the applicable pickup location's operating schedule and local time. Buywander may process, record, notify, or display no-show determinations after the missed appointment or after the end of the business day, including through automated jobs, emails, account notices, or fee-balance updates. The timing of Buywander's processing does not extend your appointment, pickup deadline, return deadline, or fee obligations.

Same-day appointment change fees and no-show fees are generally added to your account fee balance rather than deducted from an Item refund.

A same-day appointment change, same-day reschedule, cancellation, or no-show does not extend the pickup deadline or return deadline. Items that remain unpicked up after the pickup deadline may still be canceled, refunded, returned to inventory, relisted, resold, donated, recycled, disposed of, or otherwise handled under these Terms.

You are responsible for following all pickup location rules, instructions, safety protocols, posted notices, and staff directions when undertaking the pickup of an Item.

Buywander may limit, deny, or condition pickup appointments, rescheduling, cancellations, or account access based on operational capacity, warehouse conditions, account history, unpaid fees, repeated missed appointments, repeated same-day changes, repeated late pickups, failure to follow pickup location rules, instructions, protocols, suspected abuse, or other operational needs.

9. Operational Fees, Fee Balances, And Account Restrictions

Buywander may assess a $2.00 per-Item restocking fee when:

1. an Item is not picked up by its pickup deadline;
2. a won Item is removed from your cart after you have used your free monthly removal allowance, including when an unpaid won Item is automatically removed after the checkout deadline;
3. if enabled and disclosed, you change, reschedule, or cancel a pickup appointment on the same local calendar date as the appointment, based on the local time of the applicable pickup location; or
4. if enabled and disclosed, you do not check in for your scheduled pickup appointment within one (1) hour after the scheduled appointment time, or by another time disclosed to you by Buywander, and you have not completed pickup, canceled, or rescheduled through a Buywander-approved scheduling flow or written support confirmation.

Buywander may deduct applicable restocking fees, Operational Fees, unpaid account fee balances, chargeback-related amounts, or other amounts owed from refunds, credits, or other amounts owed to you where permitted by these Terms and applicable law. Buywander may also add applicable fees to your account fee balance where the fee is not deducted from a refund, where no refund is being issued, where the refund is not sufficient to cover the amount owed, or where Buywander has disclosed that the fee will be handled through your account fee balance.

Your account fee balance may include removal from cart fees, automatic cart removal fees after checkout deadlines, same-day appointment change fees, no-show fees, restocking fees that are not deducted from refunds, payment failure amounts, chargeback amounts, collection-related amounts, or other amounts owed under these Terms.

Unless Buywander states otherwise in writing or applicable law requires otherwise:

1. restocking fees for Items not picked up by the pickup deadline are generally deducted from the refund for those Items;
2. removal from cart fees after your free monthly allowance, including fees for applicable automatic cart removals after checkout deadlines, are generally added to your account fee balance;
3. same-day appointment change fees are generally added to your account fee balance; and
4. no-show fees are generally added to your account fee balance.

You are responsible for paying any account fee balance shown in your account. Buywander may provide one or more ways for you to pay your account fee balance.

If your unpaid account fee balance exceeds $20.00, Buywander may restrict your ability to place bids and use transaction features of the Buywander Platform until the balance is paid or otherwise resolved to Buywander's satisfaction.

Account restrictions may include limiting or disabling bidding, requiring payment of outstanding fees before further bidding or transaction activity, requiring support-assisted scheduling, limiting appointment options, requiring additional verification, canceling bids or orders, suspending account access, or terminating your account. Buywander may continue to provide access reasonably necessary for you to view your account, pay outstanding fees, contact support, receive required notices, complete approved pickups, or complete eligible returns, as determined by Buywander and required by applicable law.

All account fee balances and other unpaid amounts survive account restriction, suspension, termination, closure, deletion request, or discontinued use of the Buywander Platform. Closing your account, deleting the app, opting out of marketing communications, or ceasing to use the Buywander Platform does not cancel amounts you incurred before closure or discontinued use.

10. Returns And Refunds

Buywander's return and refund rules are described in the Returns, Refunds & Fees Policy and any Item-specific terms posted or presented by Buywander.

Unless Buywander states otherwise in writing, eligible Items may be returned within seven (7) business days after the auction for that Item ends. The return deadline is calculated using business days for the applicable local warehouse, as described in Section 7.

To qualify for a return, the Item must be the same Item you received, must be returned within the applicable return deadline, and must be in the same condition as when you received it.

Buywander does not offer partial refunds unless Buywander agrees in writing or applicable law requires otherwise. You either return the entire Item or keep it.

Refunds are generally issued back to the card or payment method used at checkout, unless Buywander states otherwise or applicable law requires otherwise. Refund timing may depend on Buywander's processing time and the policies of banks, card networks, and payment processors.

Buywander may deduct applicable fees, unpaid account fee balances, chargeback-related amounts, or other amounts owed under these Terms from refunds where permitted by law and disclosed to you. Restocking fees for Items not picked up by the pickup deadline are generally deducted from the refund for those Items and may be capped at the refundable amount for the Item. Other fees, including removal from cart fees, same-day appointment change fees, and no-show fees, are generally handled through your account fee balance unless Buywander discloses a different treatment.

Unless Buywander agrees otherwise in writing or applicable law requires otherwise, an approved refund is your sole remedy for an Item return, canceled Item, unavailable Item, listing error, operational issue, or other Item-specific issue. Buywander is not required to provide a replacement Item, substitute Item, price match, future auction credit, lost-opportunity compensation, incidental compensation, or other remedy beyond the applicable refund.

Certain Items may be excluded from return, including perishable goods, food, flowers, plants, custom products, special orders, personalized items, personal care items, beauty products, hazardous materials, flammable liquids, gases, sale items, gift cards, Items marked final sale, Items marked non-returnable, and other Items identified by Buywander as non-returnable.

If an Item is not as expected or does not match the listing, you may return it if it is eligible under the Returns, Refunds & Fees Policy. You are responsible for reviewing Item photos, descriptions, condition information, pickup location, return eligibility, and other Item details before bidding.

Buywander may reject returns that are late, incomplete, altered, damaged after pickup, mismatched, fraudulent, abusive, or otherwise inconsistent with these Terms or the Returns, Refunds & Fees Policy.

11. Missing Items, Listing Errors, Risk of Loss, And Operational Issues

Because Buywander sells returned, overstock, open-box, used, liquidation, and similar inventory, availability and Item information may vary. Buywander may discover after an auction ends that an Item is missing, damaged, incorrectly listed, unavailable, unsafe to release, or otherwise unable to be fulfilled.

If Buywander cannot locate or release an Item you won, Buywander's sole obligation is to refund the amount you paid for that Item, unless applicable law requires otherwise. Buywander is not required to provide a replacement Item, price match, substitute Item, future auction credit, credit for lost opportunity, reimbursement for travel or time, or compensation beyond the amount paid for the unavailable Item.

If Buywander cancels, refunds, withdraws, relists, or otherwise resolves an Item, listing, auction, order, appointment, or transaction because of an operational issue, listing error, inventory issue, safety issue, suspected fraud, system error, payment issue, policy violation, missed pickup deadline, or abandoned Item, your rights are limited to the refund or other remedy expressly provided by Buywander in writing or required by applicable law.

Buywander may cancel, refund, relist, withdraw, or correct any Item, listing, auction, order, appointment, or transaction where Buywander identifies an operational issue, listing error, inventory issue, safety issue, suspected fraud, system error, payment issue, or policy violation.

Risk of loss, damage, theft, handling, transportation, use, and disposal passes to you when an Item is released to you, your representative, agent, vehicle, or any party acting on your behalf. Except to the extent expressly set forth herein or as otherwise required by applicable law, Buywander is not responsible for loss, damage, injury, transportation costs, or any other costs or consequences after the release of an Item to you.

12. Support Exceptions And Waivers

Buywander may waive fees, extend deadlines, allow exceptions, or provide accommodations in its discretion, including for Buywander-caused delays, pickup location closures, system outages, documented support issues, severe weather, emergency conditions, or other circumstances approved by Buywander in writing. Buywander may require documentation or account review before granting an exception.

A waiver, extension, accommodation, or exception in one instance does not require Buywander to provide the same or similar waiver, extension, accommodation, or exception in any other instance.

Only written confirmation from Buywander support or another authorized Buywander representative creates an exception to these Terms. General conversations, informal statements, or support discussions do not change these Terms unless Buywander confirms the exception in writing.

13. Account Conduct

You agree not to misuse the Buywander Platform or interfere with Buywander's operations. Prohibited conduct includes:

1. providing false, inaccurate, incomplete, or misleading account information;
2. using another person's account or payment method without authorization;
3. creating duplicate accounts to evade restrictions, fees, or free removal limits;
4. bidding without intent to pay or pick up;
5. manipulating auctions or coordinating bids;
6. using bots, scrapers, automated tools, or unauthorized scripts;
7. interfering with Buywander systems, auctions, listings, checkout, appointments, removals, returns, or communications;
8. submitting fraudulent returns, false disputes, or abusive support claims;
9. abusing Buywander staff, contractors, customers, sellers, or service providers;
10. violating pickup location rules or safety instructions;
11. using the Buywander Platform for unlawful purposes; or
12. violating these Terms or any Buywander policy.

Buywander may investigate suspected violations and may restrict, suspend, or terminate accounts, cancel bids or transactions, refuse pickup, deny returns, require additional verification, preserve records, cooperate with law enforcement, or take other action Buywander considers appropriate.

14. Communications And Notices

By creating an account or using the Buywander Platform, you consent to receive electronic communications from Buywander, including emails, text messages, push notifications, in-app notices, account notices, transaction notices, appointment notices, pickup reminders, fee notices, refund notices, return notices, policy notices, and legal notices.

Transactional communications are part of Buywander's services and may include bid confirmations, outbid notices, auction results, cart notices, checkout reminders, checkout deadline notices, automatic cart removal notices, payment confirmations, pickup deadlines, return deadlines, appointment confirmations, appointment reminders, same-day appointment change notices, no-show notices, fee balance notices, refund notices, return notices, account alerts, fee confirmations, receipts, and policy updates.

You are responsible for keeping your contact information current and for monitoring your email, text messages, account notices, Orders page, and other Buywander communications. Failure to receive or read a communication does not relieve you of your payment, pickup, appointment, return, fee, or account obligations.

You may be able to opt out of certain marketing communications, but you may not opt out of transactional, account, legal, safety, payment, pickup, return, fee, or policy communications while maintaining an active Buywander account.

Electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.

15. Payment Disputes And Chargebacks

If you believe there is an error with a charge, fee, refund, Item, appointment, return, or account balance, you must contact Buywander support promptly and give Buywander a reasonable opportunity to investigate and resolve the issue.

You agree not to initiate a chargeback, payment reversal, or similar payment dispute for a transaction that Buywander is actively reviewing or has resolved under these Terms, unless you believe in good faith that your payment method was used fraudulently without your authorization or applicable law gives you a non-waivable right to do so.

If you initiate a chargeback, payment reversal, or similar payment dispute for a valid charge, fee, or transaction, Buywander may restrict, suspend, or terminate your account, add the disputed amount and any related fees, processor fees, administrative costs, or chargeback-related amounts to your account fee balance where permitted by law, deduct amounts from refunds or credits where permitted, provide evidence to the payment processor, and pursue any remedies available under these Terms or applicable law. Buywander is not responsible for decisions made by banks, card networks, or payment processors.

If a chargeback, payment reversal, or similar payment dispute causes Buywander to refund, reverse, or lose funds for an Item, fee, appointment, order, or transaction that was validly charged or already fulfilled, you remain responsible for the disputed amount and any related amounts permitted by law. Buywander may require repayment before allowing additional bidding, checkout, appointment scheduling, pickup, returns, or other transaction activity.

Nothing in these Terms limits any non-waivable right you may have to contact a regulator, file a complaint with a government agency, report suspected unlawful conduct, or exercise rights that cannot be waived under applicable law.

Chargeback obligations, unpaid balances, Operational Fees, account fee balances, and related costs survive account restriction, suspension, termination, closure, deletion request, or discontinued use of the Buywander Platform.

16. Third-Party Services

The Buywander Platform may link to, integrate with, or rely on third-party services, including payment processors, messaging providers, logistics providers, maps, analytics services, support tools, identity verification services, and other service providers.

Buywander is not responsible for third-party services, third-party websites, third-party content, third-party payment decisions, third-party delays, third-party errors, or third-party acts or omissions.

Your use of third-party services may be subject to separate terms and privacy policies from those third parties.

17. Intellectual Property

The Buywander Platform, including text, graphics, logos, icons, images, software, designs, interfaces, data, content, trademarks, service marks, trade names, and other materials, is owned by Buywander or its licensors and is protected by intellectual property and other laws.

Subject to your compliance with these Terms, Buywander grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Buywander Platform for personal, non-commercial use in connection with browsing, bidding, purchasing, pickup, returns, and account management.

You may not copy, modify, scrape, reproduce, distribute, reverse engineer, decompile, frame, mirror, sell, resell, exploit, or create derivative works from the Buywander Platform or its content except as expressly permitted by Buywander in writing.

18. Feedback And User Content

If you submit reviews, comments, photos, feedback, suggestions, ideas, questions, or other content to Buywander, you grant Buywander a perpetual, worldwide, royalty-free, irrevocable, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that content for any lawful purpose.

You represent that you have the rights necessary to submit any content you provide and that your content does not violate any law, infringe any third-party rights, or contain unlawful, defamatory, obscene, threatening, invasive, misleading, fraudulent, or harmful material.

Buywander may remove, edit, reject, or refuse to display any user content in its discretion.

19. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE Buywander PLATFORM, SERVICES, LISTINGS, ITEMS, CONTENT, FEATURES, AND MATERIALS ARE PROVIDED ON AN "AS IS," "WHERE IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, Buywander DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Buywander DOES NOT WARRANT THAT THE Buywander PLATFORM WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, ACCURATE, COMPLETE, CURRENT, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

Buywander DOES NOT WARRANT THAT ANY ITEM WILL BE AVAILABLE, FUNCTIONAL, COMPLETE, SAFE, SUITABLE FOR A PARTICULAR PURPOSE, ACCURATELY DESCRIBED, OR FREE FROM DEFECTS, UNLESS Buywander EXPRESSLY STATES OTHERWISE IN WRITING OR APPLICABLE LAW REQUIRES OTHERWISE.

ITEMS MAY BE SUBJECT TO MANUFACTURER RECALLS, SAFETY NOTICES, WARNINGS, MANUALS, MISSING LABELS, PARTS AND INFORMATION, CONTAMINATION, AND OTHER CONDITIONS NOT KNOWN TO Buywander. YOU ARE RESPONSIBLE TO REVIEW MANUFACTURER INFORMATION, WARNINGS, LABELS, RECALLS AND OTHER INFORMATION THAT MAY OR MAY NOT BE PHYSICALLY PRESENT WITH THE ITEM.

IF ANY ITEM IS RESOLD, TRANSFERRED, EXPORTED, OR USED FOR BUSINESS OR COMMERCIAL PURPOSES, YOU ARE SOLELY RESPONSIBLE FOR ALL LEGAL, TAX, WARRANTY, PRODUCT LIABILITY AND REGULATORY OBLIGATIONS. Buywander DOES NOT AUTHORIZE YOU OR ANYONE ACTING ON YOUR BEHALF TO REPRESENT THAT Buywander IS THE MANUFACTURER, WARRANTOR, OR DISTRIBUTOR OF ANY ITEM AFTER THE TIME OF YOUR PURCHASE, EXCEPT TO THE EXTENT APPLICABLE LAW PROVIDES OTHERWISE.

Some jurisdictions do not allow certain disclaimers, so some of the above disclaimers may not apply to you.

20. Limitation Of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Buywander AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, SERVICE PROVIDERS, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST OPPORTUNITY, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, SUBSTITUTE GOODS, OR DAMAGES ARISING FROM ITEM CONDITION, ITEM USE, PICKUP, LOADING, TRANSPORT, DELAY, MISSED APPOINTMENTS, UNAVAILABLE ITEMS, OR INABILITY TO USE THE Buywander PLATFORM.

TO THE FULLEST EXTENT PERMITTED BY LAW, Buywander'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE Buywander PLATFORM, ANY ITEM, ANY AUCTION, ANY PURCHASE, ANY PICKUP, ANY RETURN, ANY REFUND, ANY FEE, OR ANY TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID TO Buywander FOR THE ITEM OR TRANSACTION GIVING RISE TO THE CLAIM AND ANY SUCH CLAIM MUST BE FILED WITHIN ONE (1) YEAR OF THE DATE THE CLAIM ACCRUES OR IT IS PERMANENTLY BARRED; PROVIDED, HOWEVER, THE LIMITATIONS PERIOD WILL NOT APPLY WHERE PROHIBITED BY LAW AND WILL BE EXTENDED IF A LONGER CLAIM PERIOD IS REQUIRED BY APPLICABLE LAW.

The limitations in this section apply regardless of the legal theory, whether based in contract, tort, negligence, strict liability, statute, equity, or otherwise, and even if Buywander has been advised of the possibility of damages.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

21. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Buywander and its officers, directors, employees, contractors, agents, affiliates, service providers, suppliers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

1. your use of the Buywander Platform;
2. your bids, purchases, cart removals, pickups, returns, appointments, disputes, or account activity;
3. your breach of these Terms or any Buywander policy;
4. your violation of law or third-party rights;
5. your misuse of Items after pickup;
6. your loading, transport, storage, resale, disposal, or use of Items;
7. your account information, payment information, communications, or user content; or
8. activity occurring under your account.

Buywander may control the defense of any matter subject to indemnification, and you agree to cooperate with Buywander's defense of those claims.

22. Account Suspension And Termination

Buywander may restrict, suspend, or terminate your account or access to the Buywander Platform at any time if Buywander believes you violated these Terms, created operational risk, created payment risk, engaged in fraud or abuse, failed to pay amounts owed, repeatedly removed won Items from your cart, repeatedly failed to complete checkout for won Items, repeatedly missed pickups, repeatedly changed appointments on the same day, repeatedly failed to pick up Items by pickup deadlines, abandoned Items, submitted excessive or abusive returns, initiated improper chargebacks, abused support, created duplicate accounts, attempted to evade account restrictions, or otherwise acted inconsistently with Buywander's policies or interests.

You may stop using the Buywander Platform at any time. Account closure does not relieve you of obligations arising before closure, including payment obligations, fee balances, chargeback obligations, dispute obligations, indemnity obligations, and any other obligations that by their nature should survive.

Buywander may retain records, including, without limitation, transaction records, communications, device information, payment information, bid history, and return records as needed for legal, tax, accounting, audit, fraud prevention, dispute, enforcement, operational purposes, and any other lawful purpose.

23. Changes To These Terms

Buywander may update these Terms and incorporated policies from time to time. When Buywander updates these Terms, Buywander will update the "Last Updated" date above and may provide notice through the Buywander Platform, email, text message, account notice, checkout flow, bid flow, cart flow, appointment flow, or another reasonable method.

Updated Terms apply as of the effective date stated in the updated Terms or notice. Your continued use of the Buywander Platform after updated Terms become effective means you accept the updated Terms.

For material changes involving pickup deadlines, return deadlines, fees, account restrictions, payment authorization, or dispute rights, Buywander may require you to accept the updated Terms before placing future bids, completing future purchases, removing future Items from cart, scheduling future appointments, or continuing to use certain account features.

Buywander may provide a grace period or transition notice for existing Items, overdue Items, appointments, or account activity. Any grace period or transition notice is provided in Buywander's discretion and does not waive Buywander's rights unless Buywander states otherwise in writing.

24. Governing Law And Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms, the Buywander Platform, any Item, any auction, any bid, any purchase, any pickup, any appointment, any return, any refund, any fee, or any account activity will be governed by the laws of the State of Washington, without regard to conflict-of-law rules, except where applicable law requires otherwise.

Before initiating any arbitration, lawsuit, chargeback, or similar adversarial dispute process, you agree to first contact Buywander at hello@buywander.com (mailto:hello@buywander.com) and attempt to resolve the dispute informally, except where prohibited by law, where you believe in good faith that your payment method was used fraudulently without authorization, where urgent injunctive relief is needed, or where applicable law gives you a non-waivable right to proceed without informal resolution first.

If the dispute cannot be resolved informally, you and Buywander agree to resolve the dispute through binding arbitration administered by the American Arbitration Association under its applicable rules, except where applicable law requires otherwise. Arbitration will be conducted by a single neutral arbitrator. Unless applicable law requires otherwise, arbitration will take place in Spokane County, Washington, or remotely if the parties agree or the arbitrator permits.

You and Buywander agree that disputes will be resolved only on an individual basis. You and Buywander waive the right to bring, participate in, or recover through any class action, collective action, consolidated action, private attorney general action, or representative proceeding, except where such waiver is prohibited by law.

Nothing in this section prevents either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, platform security, account integrity, payment systems, or other urgent interests.

Judgment on an arbitration award may be entered in any court of competent jurisdiction. This dispute resolution section survives account restriction, suspension, termination, closure, and your discontinued use of the Buywander Platform.

IF ANY DISPUTE IS DETERMINED NOT TO BE SUBJECT TO ARBITRATION, OR IF THE ARBITRATION OBLIGATIONS SET FORTH HEREIN ARE FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM OR REQUEST FOR RELIEF, YOU AND Buywander EXPRESSLY WAIVE THE RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW AND ANY SUCH PROCEEDING SHALL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS, COLLECTIVE ACTION, CONSOLIDATED ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR REPRESENTATIVE PROCEEDING, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW.

25. Miscellaneous

These Terms, together with all policies and terms incorporated by reference, are the entire agreement between you and Buywander regarding the Buywander Platform and supersede all prior or contemporaneous agreements on that subject.

If any provision of these Terms is found unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Buywander's failure to enforce any provision of these Terms is not a waiver of that provision or any other provision.

You may not assign or transfer these Terms, your account, your bids, your orders, your pickup rights, your return rights or any other rights or obligations under these Terms or your account without Buywander's prior written consent. Buywander may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, financing, reorganization, by operation of law, to an affiliate, or to any successor.

Headings are for convenience only and do not affect interpretation.

Provisions that by their nature should survive termination will survive, including payment obligations, fee balances, account restrictions, disclaimers, limitations of liability, indemnification, dispute provisions, intellectual property provisions, and record retention rights.
